Welcome to RecipMe. These Terms of Service (“Terms”) govern your access to and use of the RecipMe platform, including our website, applications, and services (collectively, the “Service”). By accessing or using RecipMe, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

2. Account Registration

To access certain features of the Service, you must register for an account. When registering, you agree to:

  • Be at least 13 years of age.
  • Provide accurate, current, and complete information during registration and keep your account information updated.
  • Maintain the security of your account credentials.
  • Accept responsibility for all activities that occur under your account.

We use Clerk for authentication. Your login credentials are managed securely through Clerk's authentication infrastructure. You may sign in using email, social login providers, or other methods supported by our authentication system.

3. User Content

The Service allows you to create, upload, store, and share content, including but not limited to recipes, articles, comments, photos, and profile information (“User Content”).

Ownership. You retain all ownership rights in your User Content. RecipMe does not claim ownership of any content you create or upload.

License Grant. By submitting User Content to the Service, you grant RecipMe a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, adapt, publish, display, and distribute your User Content in connection with operating and providing the Service. This license continues until you delete your User Content or your account, except where your content has been shared with others and they have not deleted it.

Responsibility. You are solely responsible for your User Content. You represent that you have all rights necessary to grant the licenses above and that your User Content does not infringe any third-party rights.

4. Acceptable Use

You agree not to use the Service to:

  • Post, upload, or share content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
  • Impersonate any person or entity, or falsely state or misrepresent your identity.
  • Engage in spamming, including posting unsolicited promotional content or sending bulk messages.
  • Scrape, crawl, or otherwise automatically collect data from the Service without our express written consent.
  • Interfere with or disrupt the Service or servers or networks connected to the Service.
  • Attempt to gain unauthorized access to any part of the Service, other accounts, or computer systems.
  • Use the Service for any commercial purpose not expressly permitted by these Terms.
  • Post content that contains harmful or malicious code.

5. Intellectual Property

The RecipMe name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of RecipMe or its affiliates. You may not use such marks without our prior written permission.

Content generated by our AI features (including recipe suggestions, substitutions, meal plans, and image generation) is provided for your personal use within the Service. You may use AI-generated content in your recipes and articles, but you may not systematically extract AI-generated content for use in competing services.

6. AI Features Disclaimer

RecipMe uses Google Gemini AI to power various features including recipe parsing, ingredient substitutions, meal planning, semantic search, and image generation. While we strive for accuracy:

  • AI suggestions are informational only. They are not medical, nutritional, or dietary advice. Always consult a qualified healthcare professional for medical or nutritional guidance.
  • Allergy and dietary information provided by AI may not be complete or accurate. Always verify ingredients and allergens independently, especially for severe allergies.
  • Nutritional estimates are approximate. Actual nutritional values may vary based on specific ingredients, preparation methods, and serving sizes.
  • Recipe suggestions and substitutions may not suit all tastes or skill levels. Use your own judgment when following AI-generated instructions.

7. Subscription and Billing

RecipMe offers the following tiers:

  • Free Tier: Basic access to recipe discovery, limited recipe creations, and community features at no cost.
  • Pro Tier: Enhanced features including unlimited recipe creations, AI meal planning, hands-free cooking, and priority support for a monthly subscription fee.
  • Premium Tier: All Pro features plus AI image generation, advanced analytics, family sharing, and early access to new features for a monthly subscription fee.

Billing. Subscription fees are billed in advance on a monthly basis. You authorize us to charge your payment method for the applicable subscription fee.

Cancellation. You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the end of your paid period. No refunds are provided for partial billing periods.

Free Trial. New users may receive a complimentary trial period with access to premium features. When the trial ends, you will be moved to the Free tier unless you choose to subscribe.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

RecipMe does not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected. RecipMe does not warrant the accuracy, reliability, or completeness of any content provided through the Service, including AI-generated content.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RECIPME, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of, or inability to access or use, the Service.
  • Any conduct or content of any third party on the Service.
  • Any content obtained from the Service, including AI-generated content.
  • Unauthorized access, use, or alteration of your transmissions or content.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

You may delete your account at any time through your profile settings. Upon account deletion, we will remove your personal data in accordance with our Privacy Policy, subject to a 30-day grace period during which your account can be recovered.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect, by posting the updated Terms on the Service and notifying you via email or in-app notification. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
